BYOB Sports Terms of Use

Effective date: October 20, 2026

These Terms of Use ("Terms") are a legal agreement between you and BYOB Sports LLC, a Florida limited liability company ("BYOB," "we," "us"). They govern your use of the BYOB mobile app, the website at byobsports.com, and related services (together, the "Service"). By creating an account, buying a subscription, or using the Service, you agree to these Terms, our Privacy Policy, our Subscription & Refund Policy and our Community Guidelines. If you do not agree, do not use the Service. THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS.

 

1. Eligibility

You must be at least 18 years old to create an account or use the Service. By using the Service, you confirm that you are 18 or older and legally able to enter into these Terms. You may not use the Service if you are barred from doing so under applicable law. If we learn that a user is under 18, we will close the account.

 

2. Your account

You must give accurate information when you sign up and keep it up to date. You are responsible for keeping your login details secure and for all activity under your account. Tell us right away at hello@byobsports.com if you believe your account has been used without permission. You can delete your account at any time in the app under Settings > Account > Delete Account.

 

3. The Service

BYOB helps players find, organize and join pickup games. We may add, change or remove features at any time. We will try to give notice of material changes that reduce paid features.

 

4. Subscriptions and payments

Some features require a paid subscription ("BYOB Membership"). Subscriptions bought in the app are sold and billed through the Apple App Store (the "App Store").

  • Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the period ends.

  • Billing. Payment is charged to your App Store account when you confirm the purchase and at each renewal.

  • Free trials. If we offer a free trial, it converts to a paid subscription when it ends unless you cancel at least 24 hours before it ends. Any unused part of a trial is forfeited when you buy a subscription.

  • Cancellation. You cancel through your App Store account settings. Deleting the app or your BYOB account does not cancel a subscription.

  • Price changes. We will notify you before a price increase takes effect, as the App Store requires. You can cancel before the new price applies.

  • Refunds. Refunds are handled by the App Store under its policies. See our Subscription & Refund Policy.

 

5. Physical activity and meeting other users

Sports and physical activity carry a risk of injury. You participate in any game, practice or activity found or organized through the Service voluntarily and at your own risk. Consult a doctor before starting any new physical activity. We do not employ, screen or supervise other users, organizers or venues, and we are not responsible for their conduct, the condition of any venue, or what happens at any game or meetup. Use common sense when meeting people you do not know. We do not conduct background checks or verify the identity of users. To the fullest extent permitted by law, you release BYOB from any claims, injuries, losses or damages arising from games, venues, or your interactions with other users.

 

6. User content

You may post content such as profile details, photos, messages, game listings and comments ("User Content"). You keep ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, adapt and distribute it to operate, improve and promote the Service. This license ends when you delete the content or your account, except for copies kept in backups, as required by law, or already shared by other users.

You are responsible for your User Content and confirm you have the rights to post it. We may remove any User Content at any time.

 

7. Rules of conduct

You agree not to:

  • Harass, threaten, bully or discriminate against anyone

  • Post content that is unlawful, hateful, sexually explicit, violent or misleading

  • Impersonate anyone or misrepresent your identity or age

  • Use the Service to contact or arrange meetups with anyone under 18

  • Spam, scrape, reverse engineer or interfere with the Service or its security

  • Use the Service for unauthorized commercial purposes

  • Violate any law or anyone else's rights

 

You can report or block users by selecting “Report Player” or “Block Player” on any player’s profile in the app, or by emailing hello@byobsports.com. BYOB has zero tolerance for objectionable content or abusive users. We review reports and act on them within 24 hours, which may include removing content and suspending or banning the user responsible. You must also follow our Community Guidelines at byobsports.com/safety. If they conflict with these Terms, these Terms control.

8. Our intellectual property

The Service, including its software, design, logos and content we provide, belongs to BYOB or its licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your personal, non-commercial use, in line with these Terms and the App Store's usage rules. Feedback you send us may be used without any obligation to you.

9. Third-party services

The Service may link to or use third-party services, such as maps, venues or payment providers. We do not control them and are not responsible for them. Their own terms and privacy policies apply.

10. Suspension and termination

You may stop using the Service at any time. We may suspend or end your access if you break these Terms, create risk or legal exposure for us or other users, or if we stop offering the Service. Sections 4 (for amounts owed), 5, 6, 8 and 11 through 17 survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT INFORMATION IN IT (INCLUDING STATS, SCHEDULES OR LOCATIONS) IS ACCURATE.

12. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, BYOB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $100. Some places do not allow these limits, so they may not apply to you.

 

13. Indemnity

You agree to defend and indemnify BYOB and its officers, employees and agents against claims, losses and costs (including reasonable legal fees) arising from your User Content, your conduct, or your breach of these Terms.

 

14. Changes to these Terms

We may update these Terms. If a change is material, we will notify you in the app or by email before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms. Changes to Section 15 will not apply to any dispute that arose before the change was posted.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions below.

Informal Dispute Resolution. Before initiating arbitration, each party agrees to send the other a written notice describing the dispute (for you, to hello@byobsports.com, including your name and account email) and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration. If a dispute cannot be resolved informally, you and BYOB Sports LLC agree to resolve disputes arising out of or relating to these Terms or your use of the BYOB Sports platform through binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, except where prohibited by law.

Class Action Waiver. To the fullest extent permitted by law, you and BYOB Sports LLC agree that disputes will be resolved solely on an individual basis and not as part of any class, collective, consolidated, or representative action.

Exceptions. Either party may bring an eligible individual claim in small claims court. Nothing in this section limits rights or remedies that cannot legally be waived or subjected to arbitration.

Jurisdiction. For disputes that are not subject to arbitration, the parties consent to the jurisdiction of the state and federal courts located in Miami-Dade County, Florida, subject to applicable law.

Arbitration Costs. Arbitration fees and costs will be allocated in accordance with the applicable AAA Consumer Arbitration Rules and governing law.

16. Apple App Store terms

If you downloaded the app from the Apple App Store, these additional terms apply:

  1. These Terms are between you and BYOB only, not Apple. BYOB, not Apple, is solely responsible for the app and its content.

  2. Your license to use the app is limited to Apple-branded products you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions.

  3. BYOB is solely responsible for maintenance and support of the app. Apple has no obligation to provide any maintenance or support.

  4. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent allowed by law, Apple has no other warranty obligation for the app. BYOB is responsible for any other claims, losses or costs from any failure to conform to a warranty.

  5. BYOB, not Apple, is responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.

  6. If a third party claims the app or your use of it infringes their intellectual property rights, BYOB, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.

  7. You confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

  8. You must comply with any applicable third-party terms, such as your wireless data service agreement, when using the app.

  9. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
     

17. General

These Terms, with the Privacy Policy, Subscription & Refund Policy and Community Guidelines, are the entire agreement between you and BYOB about the Service. These If any part is found unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
